Swiss-Link, Inc. – Terms & Conditions of Sale

Welcome to Swiss-Link, Inc. These Terms and Conditions govern all sales of products and services from our company. By placing an order with us, you agree to be bound by the terms outlined below. This page serves as the official source for our policies and is referenced on all our invoices and order confirmations.

1. General Terms

  • 1.1. Our Agreement: These terms, along with the details on your specific invoice or order confirmation, form the entire agreement between you and Swiss-Link, Inc. They take precedence over any other terms, including those on a customer's purchase order. We may update these terms from time to time; the version in effect at the time of your order will apply.
  • 1.2. Payment: All payments shall be made in USD. Invoices are due upon receipt unless a different due date is explicitly stated on your invoice. For accounts with approved credit, late payments may be subject to a penalty of 10% on the outstanding balance. We reserve the right to suspend shipments to accounts with overdue balances.
  • 1.3. Inspection and Acceptance: Please inspect your order upon delivery. You have five (5) business days from the date of receipt to report any discrepancies or visible damage. If we do not receive a written objection within this period, the order shall be considered accepted. To file a claim, please contact our Customer Service team in writing.
  • 1.4. Intellectual Property: All trademarks, copyrights, and designs associated with our products remain the sole property of Swiss-Link, Inc. or our licensors.
  • 1.5. Confidentiality: We are committed to protecting your proprietary information, and we expect the same in return for any sensitive business information we may share with you.
  • 1.6. Order Cancellation: Once an order has been processed for shipment, it cannot be canceled. For special orders or those requiring immediate payment, cancellation is not permitted after fourteen (14) days from the original order date.

2. Shipping & Delivery

  • 2.1. Special Handling: If your order requires special packing, such as adjusting standard carton quantities, a fee of $2.50 per box may apply.
  • 2.2. Freight (LTL/FTL) Deliveries: For large orders shipped on a pallet, you must inform us of any special delivery requirements when placing your order. This includes needing a liftgate, a delivery appointment, or access restrictions. You will be responsible for any fees incurred due to undisclosed requirements, such as redelivery or detention fees.

3. Return & Restocking Policy

  • 3.1. How to Make a Return: All returns must be pre-approved. To start a return, please contact our Customer Service team to obtain a Return Merchandise Authorization (RMA) number.
  • 3.2. Condition of Returns: Returned items must be in new, unaltered, and saleable condition, complete with their original packaging.
  • 3.3. Restocking Fee: Approved returns of non-defective products are subject to a 15% restocking fee, which will be deducted from your refund.
  • 3.4. Shipping Costs: Original shipping and handling fees are non-refundable. You are responsible for all return shipping costs unless the return is due to our error.  
  • 3.5. Damaged or Lost Items: If your order was damaged in transit, please notify us within seven (7) days of delivery with detailed photos. If we arranged the shipment, we will manage the claim with the carrier. If you arranged shipment, we will provide reasonable assistance for your claim.
  • 3.6. International Returns: We do not accept returns on international orders.

4. Policies for Resellers

Note: If you purchased our products for your own use, this section does not apply to you.

  • 4.1. Wavian Fuel Cans (California Sales): In compliance with state regulations, only Red (Gasoline), Yellow (Diesel), and Blue (Kerosene) Wavian Fuel Cans may be sold for delivery within California.
  • 4.2. Amazon Sales: To maintain brand and distribution integrity, the listing and sale of any Swiss-Link, Inc. sourced products on Amazon.com or its affiliates is strictly prohibited.
  • 4.3. Minimum Advertised Price (MAP) Program: We enforce a MAP policy to protect our brand's value. As a Reseller, you may not advertise MAP-protected products below their designated price. A current MAP schedule is provided to all Resellers. Violations will result in account suspension.
  • 4.4. Dropship Program: We offer a dropship program for approved Resellers. Program fees apply, and you must provide your own FedEx or UPS shipping account. Resellers are responsible for handling all of their customers' returns.
  • 4.5. Indemnification: As a Reseller, you agree to indemnify and hold Swiss-Link, Inc. harmless from any claim for damages brought against you by an end consumer.
  • 4.6. Shipping Promotions: The shipping promotion on the wholesale portal for domestic shipments applies only to prepaid orders placed via the website. All shipping promotions listed online are not available on orders with NET payment terms or additional discounts.

6. Legal Information

  • 6.1. Limitation of Liability: Our liability to you for any reason is limited to the purchase price of the product or service in question. We are not liable for any indirect, special, or consequential damages.
  • 6.2. Governing Law: This Agreement and any disputes shall be governed by the laws of the State of California. All legal proceedings shall take place in the state or federal courts located in Butte County, California.
